Learner driver who ‘can’t pass theory test’ flipped mother’s car in 2am lone drive

A man who has failed his theory test multiple times took his mother’s car and flipped it during a 2am drive without a supervisor, a court heard.

Jay Giles, 21, crashed the Mazda Bongo camper van into a wall on Bridge End Road, causing it to overturn in the early hours of 12 March this year.

Pauline Lambert, prosecuting, told Swindon Magistrates’ Court that the defendant sat on the grass next to the vehicle and waited for the police to arrive.

She said his mother did not know the vehicle had been taken and was asleep at the time.

Giles, of Goddard Avenue, Old Town, pleaded guilty to driving without a licence and without insurance.

He told officers that he keeps failing his theory test, but on the morning in question, he said he had simple being driving too fast and lost control on the corner.

Emma Thacker, defending, said her client had a “moment of madness” after “struggling to master” the theory test, and failing numerous times.

She claims Giles wasn’t speeding, but turned the corner “slightly too quickly” and hit the wall of a house. Compensation of £450 was paid to the homeowner privately.

The defendant suffers from ADHA, autism and dyspraxia.

Ms Thacker says he has made a complaint against Wiltshire Police, who allegedly took Giles to the floor and broke a number of his teeth when he attempted to leave the hospital following the crash.

Magistrates imposed a £160 fine and endorsed his provisional driving licence with six points – if any more points are attained as a provisional driver, or in the first two years of driving, he will face a roads ban.

He must also pay prosecution costs of £85 and a £34 surcharge.
