A partially-dressed woman kicked a police officer ‘when he threw her on the bed face down’.

Jade Nicholson was arrested when she refused to provide her details to the police after they were called to a disorder at an address in County Road, Swindon, on Sunday 3 July.

PC Mark Jenkins was immediately greeted by a male with chest injuries when he arrived at the scene, prosecutor Pauline Lambert told Swindon Magistrates’ Court today (24 August).

He went into the property and found the 25-year-old, who was “drunk and aggressive”. The officer requested her details as part of his investigation into events, but she repeatedly refused.

PC Jenkins went on to handcuff Nicholson but when she attempted to resist, she was put face down on the bed beside her. In the struggle, she kicked the officer’s shin, causing pain.

PC Hisey Blackburn arrived at the incident and assisted in getting the defendant into the police van – but in doing so, she kicked backwards. The officer felt pain to his knee as a reault.

Nicholson, of Bothwell Road, pleaded guilty to the two assaults on police officers. The court heard that she has previous convictions for assaulting emergency workers.

Gordon Hotson, defending, said his client had an “unnerving experience there prior to police arrival”, and was upset when police arrived and wanted her details – when she’d done nothing wrong.

He said she’d become “upset and animated”, recklessly kicking PC Jenkins when he took her onto the bed face down because she felt vulnerable because she was partially dressed – with shorts and a t-shirt on.

Mr Hotson confirmed that the disorder was unconnected to Nicholson. He added that his client suffers from various mental health issues.

Magistrates imposed a £145 fine and told her to pay £85 costs and a £48 surcharge. The chair of the bench said that “compensation isn’t appropriate” in this case.
