Erratic driver refused blood sample after failing drugs wipe on two occasions

An erratic driver stopped by the police refused to provide a blood sample in custody after failing a roadside drugs wipe on two occasions.

35-year-old Stacey Bird appeared at Swindon Magistrates’ Court on Wednesday (25 August) where she admitted two counts of failing to provide a specimen for analysis.

Crown prosecutor Pauline Lambert said the Swindon woman, of Edith New Close, was witnessed driving erratically in Queens Drive at around 1.30pm on 7 April this year.

PC Williams spotted Bird dangerously swerving in front of a bus on the busy main road. When he stopped her, she provided a positive drugs wipe for cannabis and cocaine.

She was arrested and taken to Gablecross custody where she refused to provide a sample of blood.

Just four months later, on 6 August, PC Vincent spotted Bird speeding down Raleigh Avenue, where she parked before walking towards a police vehicle.

She was stopped and asked to provide a drugs wipe. It returned a positive reading for cannabis and cocaine, but again, Bird refused to provide a specimen of blood in custody.

Ms Lambert said she “point-blank refused”.

Duty solicitor Emma Hillier told the court she wants time to explore Bird’s mental health.

Magistrates adjourned the case until 30 September for a psychological and pre-sentence report to be compiled. They imposed an interim driving ban.
