A man who exposed himself at a Trowbridge bus stop feels ‘ashamed’, a court heard.
Alcoholic Marcio Magalhaes was spotted with his penis poking out of his waistband in Bythesea Road shortly before 2pm on a sunny afternoon in September.
A female passenger in a passing vehicle – which was stuck in slow moving traffic near County Hall – reported the 53-year-old to the police.
The witness claimed he was stood up with his hands in the air and had his eyes closed. She said his penis was visible and had concerns children may see it.
The defendant, at Salisbury Magistrates’ Court in October, pleaded guilty to exposure – namely intentionally exposing his genitals with intent to cause alarm or distress.
However, representing himself for sentencing at the same court on 30 November, he said he did not do the act on purpose, nor did he intend to cause anyone alarm or distress.
Magalhaes, of East Street, Warminster, told the court that he was highly intoxicated at the time of the incident and struggling with alcohol addiction.
“I felt and I feel quite ashamed”, he said. Adding: “It was not my intention to show my privates. I’m very very embarrassed, it will never happen again.”
The defendant, who has eleven previous convictions for dissimilar crimes, said that he was due to start working with Turning Point and is financially dependent on his mother, who he resides with.
Magistrates imposed an eleven-month community order. A twelve-month community order would have forced Magalhaes to register as a sex offender.
They told him to complete a six-month alcohol treatment requirement and 25 rehabilitation activity days. He must also pay £85 prosecution costs and a £114 surcharge.
