A man who threatened to kill his ex-girlfriend and her children has been told to complete a course on how to create and maintain better relationships.

Daniel Smart, 42, appeared before Salisbury Magistrates’ Court last Friday (10 September) and entered a guilty plea to two counts of malicious communications.

The defendant, of Newtown, Trowbridge, made numerous threats towards his ex-girlfriend in an X-rated rant in two short phone calls on 4 July this year.

He threatened to ‘f**k over’ his victim before calling her all manner of demeaning names in just 79 seconds, including the phrase: ‘You stinking disgusting fat ugly disgusting b**ch’.

Most notably, along with other violent threats, Smart said: ‘I’m gonna kill your kids and you’.

“When I was listening to his threatening words, I felt in complete and utter shock”, the woman wrote in a victim impact statement seen by the court.

She added: “I genuinely believed Dan would carry out the threats. The way he said those words make me shudder even thinking about it now. I was so scared.”

Magistrate Anthony Biddulph sentenced the defendant to a 12-month community order in which he must complete the Building Better Relationships Programme.

He was also fined £105 and a victim surcharge of £95. Due to his limited means, magistrates did not order him to pay Crown Prosecution Service costs.
