A trial is to be arranged for a Calne man who pleaded not guilty to a charge of drug driving.
Daniel Garfield, 31, appeared at Swindon Magistrates’ Court today, where he had denied driving whilst over the prescribed benzoylecgonine – a metabolite of cocaine – limit.
Prosecutor Kate Prince claimed the defendant, of Juniper Close, was stopped driving by police who asked him to provide a breath test and drug swipe sample in May this year.
It’s alleged he provided a negative breath test and a positive drug swipe for cocaine, before providing an evidential blood sample in custody.
Garfield is accused of providing a reading of 114ug benzoylecgonine of drug per litre of blood. The legal limit is 50ug.
He disputes that the evidential reading is correct and a trial will be arranged in due course. He will be required to provide an expert report.
The defendant will next appear before a district judge on 20 December.
