Bail breach: Man found with victim after police called to fracas in town centre

A Swindon man with bail conditions not to contact his victim was found with her when police responded to reports of a fracas, a court heard.

At Swindon Magistrates’ Court ten days ago, Thomas ‘Tommy’ Fox, 52, admitted assaulting his girlfriend in Manchester Road on Saturday 15 May.

The court imposed bail conditions which meant he was prohibited from contacting his victim directly or indirectly.

However, when police attended the scene of a disorder involving a group of males breaking out in Newbridge Square, near Swindon bus station, officers found Fox with his victim.

He was arrested and transferred to Gablecross custody. En route, he spat in the police van resulting in a deep-clean of the vehicle at a cost of £130.

Charged with breaching his bail conditions and criminal damage, and remanded in custody overnight, Fox, of Bowleymead, Eldene, appeared before magistrates this morning where he admitted both offences.

Mark Glendenning, defending, told the court Fox had no attempted to locate his victim. She had joined the group whilst he was away from the area buying more alcohol.

Taking into account that he had not gone out of his way to trying a find her, magistrates allowed him to continue on conditional bail rather than be remanded in custody.

He was fined £100 for the criminal damage to the police van.
