An ‘unintelligent’ stalker threatened to shoot and blow up the home of his ex-girlfriend.

Trowbridge man 34-year-old Jason Povey told his victim he’d carry out the threats “kids or not”, Salisbury Crown Court heard on Friday (1 September).

Prosecuting barrister Christopher Pix said the defendant previously pleaded guilty to breaching a non-molestation order by making threatening phone calls on 20 and 21 June this year.

Having recently served 20 weeks behind bars for stalking the same woman, Povey was sporting a pink suitcase with eyes and big lashes – expecting another holiday at His Majesty’s pleasure.

Mr Pix told His Honour Judge Barnett that the defendant threatened to “shoot out every window, kids or not”, “kill everyone” and “blow up the house”.

When his victim ended the phone call, he rang again, shouting: “If you do that again I’m gonna hurt you really bad. I’m around the corner, I’ve been around a few times tonight.”

The conversations – which started at 10pm and continued into the follow morning – were recorded on the woman’s next-door neighbour’s video doorbell.

When Mr Pix began explaining Povey’s previous convictions, Judge Barnett interjected, stating “drugs and violence pepper the record” back to 2003.

Moses Uzodima-Tawo, defending, told the court that his client’s eleven-year relationship with the woman – with whom he has two young children – was prohibited by social services.

His solicitor said the relationship went downhill due to “infidelity left, right and centre” and drugs and alcohol have been the two main triggering factors for his behaviour.

Mr Uzodima-Tawo said Povey has a “low level of intelligence” and when he doesn’t see a way forward, he “acts in a despicable manner”. He told of how the defendant was stopped from seeing his children by social services, but they are now allow him one unsupervised visit.

Accepting that he must have “behaved sufficiently to to be allow contact” with his children, Judge Barnett imposed a six-month prison sentence suspended for two years. Povey was told to complete the Building Better Relationships programme and 80 hours of unpaid work.

He said: “Your record is appalling and includes a stalking offence on this very woman… you are not going to get contact if you continue.

“In the hope that what I’ve been told about you is true… you are mending your ways or trying to, and with that in mind I’m going to suspend that sentence for two years.

“If you’re stupid enough to commit any further offences… back you come, you’ll be breached in respect of the suspend sentence, you’ll go to prison for 6m months and anything else you deserve on top.

“Your children are the future and you must try and build on that.”

As Povey left the dock, the he added: “I’ve given you a chance and I don’t want that chance thrown back in the court’s face, you understand that?”

The defendant responded: “Yes” and Judge Barnett said: “Very well, you may go.”
