Child sex offender caught romping in Swindon car park in broad daylight

A child sex offender was caught romping in a car park in broad daylight – and carried on when a member of the public asked him to stop.

Appearing at Swindon Magistrates’ Court today (5 December), Carl Kavanagh, 38, pleaded guilty to outraging public decency.

This crime comes just seven months after he was handed a suspended sentence for trying to groom a 14-year-old girl by calling her “fit” and suggesting they meet.

Prosecutor Tom Power said a member of the public heard “sexual moaning” coming from Spring Gardens Car Park at around 2.30pm on 25 October last year.

Investigating, the concerned citizen sought the source of the noise and located the defendant, who is homeless and currently residing in The Salvation Army hostel Booth House next door, engaged in sexual intercourse with a woman.

The woman – said to be Kavanagh’s girlfriend – was bent over, exposed and holding on to railings during the mid-afternoon car park romp.

The member of the public went up to the pair and requested they stop. To which he aggressively replied “I don’t give a f**k” and continued having intercourse.

Understandably, the police were called and provided image evidence of the act.

The case had to be adjourned on 21 December, when he turned up to court paralytic before being removed from the court building.

Probation officer Michelle James told the court that Kavanagh was complying with his six-month suspended sentence order received for sexual communication with a child.

Mark Glendenning, defending, said his client accepts it was him and accepts he was having sex in a public place.

He told of how Kavanagh and his girlfriend both live in Booth House, where there are rules preventing mixing in each other’s rooms so they went to the car park next door.

District Judge Joanna Dickens said: “It’s pretty disgusting. I’m not suggesting anyone should break the law, but if you are going to break the law in relation to this kind of thing, pick your place.

“It’s gross, ultimately it’s disgusting, people can see it.

“One of the most disgusting parts of this is when a perfectly proper person comes to tell you to stop, you continue. It’s disgusting.”

Ms Dickens said it would be unjust to active his suspended sentence because it would “undo all the good work done so far” and instead opted to extend it.

She handed Kavanagh an eight-week prison sentence suspended for 24 months and reserved any further breaches of the order to herself.

“Come back to me for any other offences, you will go to prison”, she said.
