A man has been fined for possessing drugs after he resisted arrest in the street.

Stephen Rushton, 41, pleaded guilty to resisting arrest, threatening or abusive behaviour and possession of cocaine at Swindon Magistrates’ Court earlier this month.

The defendant was arrested after Wiltshire Police responded to reports of a disturbance at his home in Frobrisher Drive, Walcot, on 15 May this year.

Crown prosecutor Keith Ballinger said that when officers arrived on scene, they found three people drinking inside the address.

They became aggressive towards them before defendant arrived home and joined in – telling the officers they must leave and tried to prevent them talking to those within his property.

PC Rowley and her colleagues attempted to detain Rushton on suspicion of breach of the peace, but he pushed the officer and fled.

He was located a short time later and began shouting at the officers, calling them “c**ts” and “f**king idiots”. He was arrested.

Mr Ballinger said Rushton offered no comment in custody, and told the court he has previous drugs offences on his record.

Defending, Mark Glendenning said his client, a groundworker, was not present at the first incident but arrives after the police.

“He effectively asked them to leave but they persisted”, he said.

Adding: “He accepts he was abusive and accepts his comments towards the police officers.

“He accepts he pushed past them, but caused no injuries, to resist arrest.”

Magistrates fined him £720 and told him to pay costs of £85 and a victim surcharge of £75.
