A man ran over a woman’s foot when she attempted to stop him driving fearing he had consumed too much alcohol, a court heard.

The victim saw 22-year-old Michael Kasprzak getting into a Volkswagen Polo outside Buzz Bingo in Greenbridge Retail Park, Swindon, on 5 September last year.

Concerned he had drunk too much alcohol, the woman stepped in front of the car in an attempt to prevent him from driving off. He continued, driving over her foot. She didn’t suffer any serious injuries.

Lorry driver Kasprzak, who is expecting a baby with his partner, says he did not know he had injured the woman but accepts a charge of driving without due care and attention. He also accepted he was not insured to drive the car as a third party, but believed he was at the time.

District judge Joanna Dickens told the defendant, of Purton Stoke, it was a “very serious incident”.

Continuing: “That lady appears to be your friend, she seemed to be trying to help you. Even if you didn’t think she was right about the alcohol she was acting in good faith by trying to help you and your pregnant wife.

“Ultimately, she’s acting as a really good friend and a good citizen and for her pains, she gets her foot run over.

“I don’t believe you did that deliberately, I don’t believe you wanted to do that to her. And I don’t actually believe that you know that you’d done it, because I think if you did, you probably would have stopped.

“Though, you were still acting in an incredibly dangerous way. What you did was very aggressive and highly dangerous and you shouldn’t have done it.”

Accepting the fact he is a hard-working man, working as a lorry driver, she endorsed his driving license with eight points but did not impose any additional points for driving without insurance.

He was also ordered to pay a fine of £150, costs of £85 and a victim surcharge of £34.
