A XL Bully in Swindon – which does not have an exemption certificate – may be ‘destroyed’ after she was walked without a muzzle.

33-year-old Nikita Berry pleaded guilty to two offences under the Dangerous Dogs Act when she appeared at Swindon Magistrates’ Court on 10 April.

The defendant, of Tudor Walk, Walcot, admitted taking the dog, named Phenny, into Keble Close, Nythe, without a muzzle on 20 February.

She also accepted possessing the banned breed without an exemption certificate.

“Magistrates having considered facts of case and dog behaviour and that the owner is a fit and proper person find that the dog is not a risk to public safety”, court documents said.

The bench made a contingent destruction order, giving Berry two months to obtain an exemption certificate. If it is not obtained by 10 June, the dog will be put to sleep.

Berry was also sentenced to a 12 month community order for for assault, theft and criminal damage. She must also pay £100 in compensation.

It came after an incident at Morrisons on 9 February this year – whereby a man was assaulted, baked good and perishable items to the value of £68.25 were damaged and £49.70 worth of goods were stolen.
