Uninsured drink driver handed roads ban after ‘bad driving’ in Swindon

An uninsured drink driver has been handed a roads ban after his ‘bad driving’.

Police stopped Daniel Lewis driving a Peugeot RCZ after it was spotted “braking sharply and swerving” in Kingshill Road, Swindon, on 23 April this year.

Kate Prince, prosecuting, said that the vehicle was pulled over by officers at around 3am. Concerned he was intoxicated, a roadside breath test was conducted.

After providing a positive sample, he was arrested. In custody he provided an evidential reading of 57 microgrammes of alcohol in 100 millilitres of breath – when the legal limit is 35 microgrammes.

Checks revealed he was also driving without a valid insurance policy.

Lewis pleaded guilty to drink driving, driving without insurance and failing to surrender to court at Swindon Magistrates’ Court on 15 September.

Ms Prince said that the defendant, of Watercrook Mews, has a previous conviction for drink driving in 2018 – meaning he must be disqualified for three years.

Mark Glendenning, defending, said his client has been at a party with friends and was making his way home.

He said that Lewis thought he would be under the limit after a period of time had passed since his last drink – but that was “clearly not” the case.

Mr Glendenning told the court that the defendant is not working, has been laid off as a bricklayer and is currently applying for benefits.

Magistrates imposed a three-year mandatory driving ban and a £120 fine. He must also pay £85 costs and a £64 surcharge.
